Terms of use

Last updated: · Version 1.0

Welcome to Platoo (“Platoo”, “platform”, “we”, “us”). These Terms of Use are a legally binding agreement between the User and Platoo and govern access to and use of all parts of the platform: the informational website (platoo.gr and platoo.io), the venue’s admin panel and the digital menu available via QR code.

Acceptance of the terms

These Terms of Use are read together with the Privacy policy and the Cookie policy, which together form the legal basis for using the platform.

If you use the platform on behalf of an organization (e.g. a restaurant or restaurant chain), you confirm that you have the authority to accept the Terms on its behalf. The platform is intended only for people who are at least 13 years old. If you do not agree to these Terms, you must stop using the platform immediately.

1. Definitions

  • Establishment — a restaurant, café, bar or other food service business using the platform.
  • Administrator — an authorized person managing the establishment’s account.
  • Account — personalized access to the service, including credentials and data related to the use of the platform.
  • Visitor — an individual viewing the menu via the QR code.
  • Payment data — data used by a third-party payment operator to process transactions.
  • Establishment content — any data, images, dish descriptions and prices uploaded by the establishment.
  • Personal data — any information about an identifiable individual under the GDPR, CCPA and other laws.

2. Description of services

  • Website — information about the platform, pricing, privacy policy, terms of use and registration links.
  • Admin panel — tools to manage the menu, prices, images, analytics and establishment settings. The administrator can activate a subscription, manage payments and edit the menu.
  • Menu — displays the establishment’s data to visitors. A visitor can add dishes to a list without placing an order; orders are placed through a waiter. The menu is not a POS system.

3. Registration and accounts

3.1 Registration. Registration is required only for administrators in the admin panel; there is no registration on the website or in the menu. By registering, the administrator agrees to provide accurate and up-to-date information. A visitor can view the menu without registration.

3.2 Account responsibility. The administrator is responsible for keeping the login and password secure and for actions performed through the account. The platform is not responsible for loss of access caused by user negligence.

3.3 Suspension and deletion of accounts. The platform has the right to:

  • block an account in case of violation of these Terms,
  • delete an account at the user’s request,
  • delete an account after 3 months of inactivity,
  • suspend access in case of security threats or suspected fraud.

4. Use of the platform

4.1 Permitted actions. The user may use the platform only within its intended functions: viewing information about the platform, managing the menu and displaying it to visitors, using analytics and the subscription.

4.2 Prohibited actions. The user is not allowed to:

  • violate the laws of their country,
  • upload false, illegal or offensive material,
  • violate copyright,
  • interfere with the platform’s operation or attempt to breach its security,
  • bypass the billing system,
  • use the platform outside its intended functions.

Platoo reserves the right to remove content that violates these Terms.

5. User content

5.1 Responsibility for content. The establishment is fully responsible for the data it uploads: dish descriptions and ingredients, possible allergens, prices, images and photo licensing, and any other data.

Platoo displays menu information as provided by the establishment and does not guarantee the accuracy of descriptions, prices, ingredients or allergen information. The establishment is fully responsible for the content of the menu. Platoo is not liable for any damage caused by incorrect information on the establishment’s menu.

5.2 License. By uploading content, the user grants the platform a non-exclusive, worldwide, royalty-free license to store, process and display it within the platform.

5.3 Data deletion. When the user deletes content, it is removed from the platform, except where retention is required by law (e.g. for accounting or security).

6. Changes to Platoo

The platform is provided “as is” and its functionality may change unilaterally. We may update, modify or discontinue features without any obligation to maintain them or ensure backward compatibility. The user acknowledges that such changes are not grounds for claims or refunds.

7. Payments, subscriptions and refunds

7.1 Subscriptions. Paid features are provided on a subscription basis. When the paid period ends, the user must renew the subscription. If payment is not received, the platform may restrict access to paid features until payment is made. The user may cancel the subscription at any time; access to paid features remains until the end of the paid period.

7.2 Payments. Platoo does not process payments directly and is not a payment service. Platoo does not store or process bank card details. All payments are processed exclusively by the third-party processor Stripe. Platoo is not responsible for failures, delays, chargebacks or actions of such processors.

7.3 Refunds. Refunds are provided in accordance with applicable law and the refund policy. The company may refuse a refund if the service has already been provided.

8. Privacy, data and cookies

8.1 Personal data is processed in accordance with the GDPR (EU), CCPA (California), UK GDPR and other applicable laws. Details are in the Privacy policy.

8.2 The platform uses necessary technical cookies, analytics cookies and third-party cookies (Google Analytics and others). Visitors manage cookies through the consent banner. More in the Cookie policy.

8.3 Data may be transferred to servers in other countries using Standard Contractual Clauses (SCC) and other mechanisms recommended by the GDPR.

9. Analytics

The platform may collect anonymized data: number of menu views, interactions with interface elements, device technical data and other usage information. Our own analytics, Google Analytics or other tools may be used. Visitors are informed in the Privacy policy and the Cookie policy.

10. Limitation of liability

10.1 The platform is provided “as is”. Platoo does not guarantee that the services will operate without interruption, that content will be accurate, that analytics will be fully correct, or that Platoo will meet the user’s specific expectations.

10.2 Platoo is not responsible for loss of the establishment’s profit, hardware malfunctions, menu errors, malicious actions of third parties, actions of waiters or establishment staff, or the accuracy of data entered by the administrator. The company is not responsible for the consequences of visitors’ use of the menu.

10.3 Platoo may integrate with third-party services (Google Analytics, payment systems and others) and is not responsible for their operation or terms.

10.4 Platoo is not liable for failures or delays in performing its obligations caused by events beyond its reasonable control, including natural disasters, war, internet outages, government actions or failures of third-party suppliers.

11. Termination of use

11.1 The platform may stop providing services in case of violations of these Terms, legal requirements, security threats or termination of platform support.

11.2 The user may stop using the platform at any time.

12. Applicable law and dispute resolution

These Terms are governed by general principles of international contract law unless stated otherwise in separate agreements. Disputes are resolved through negotiation; if unsuccessful, through arbitration or court in the jurisdiction specified by Platoo.

13. Intellectual property

13.1 All components of the platform (design, code, logos, interface, text) are owned or licensed by Platoo.

13.2 The user may not copy the platform or any of its parts, create derivative products, inject third-party code into the platform’s code, or sell or transfer parts of the platform.

14. Changes to the Terms

We may update these Terms from time to time; changes appear on this page, with the date of the last update at the top. Continued use of the platform means acceptance of the changes.
